This Privacy Policy describes how Lucid Realty, LLC and Lucid Private Market (collectively, "Lucid," "we," "us," or "our") collect, use, disclose, and protect your personal information when you use our websites (lucidoffer.com and lucidprivatemarket.com), our marketplace platform, and our brokerage services.
By using our services, you agree to the collection and use of information in accordance with this policy. If you do not agree, please do not use our services.
This policy covers two related entities: Lucid Realty, LLC, a licensed Florida real estate brokerage, and Lucid Private Market, a technology platform that facilitates private real estate transactions. These entities share common ownership and may share data as described in this policy. Both entities are referred to collectively as "Lucid" throughout this document.
Information you provide directly:
Contact information (name, email address, phone number, mailing address). Account credentials. Property information submitted through listing intake forms. Financial information including proof of funds documentation, pre-approval letters, budget ranges, and financing type. Buyer profile information including purchase timeline, areas of interest, buyer type, and property preferences. Identity verification information. Messages sent through the platform. Offer terms and transaction-related documents. Form submissions and quiz responses.
Information collected automatically:
Device information (browser type, operating system, device identifiers). Log data (IP address, access times, pages viewed, referring URLs). Usage data (features used, searches performed, actions taken on the platform). Cookies and similar tracking technologies as described in Section 7.
Information from third parties:
Identity verification results from third-party verification providers. Payment processing information from Stripe (we do not store full payment card numbers). SMS verification confirmations from Twilio.
We use collected information to:
Provide, operate, and maintain our platform and brokerage services. Process buyer verification and maintain verified buyer status. Facilitate private marketplace functions including anonymized buyer search, invite-to-offer workflows, messaging, and offer management. Process payments for buyer memberships. Communicate with you about your account, listings, invitations, and offers. Send transactional notifications (invitations received, offer status changes, verification updates). Enforce platform rules and protect against fraud or misuse. Maintain audit logs of platform activity for compliance and dispute resolution. Comply with legal obligations, including Florida real estate licensing requirements. Improve our services based on usage patterns.
We do not sell your personal information. We do not use your information for third-party advertising.
The Lucid Private Market platform is designed with specific buyer privacy protections. Buyer profiles displayed to sellers are anonymized — no names, email addresses, phone numbers, or physical addresses are visible in the seller search directory. Seller search is limited to structured filters (budget range, financing type, timeline, areas of interest, buyer type, verification status). Free-text search of buyer profiles is not available.
Buyer identity is revealed to the seller only upon offer submission, and only after the buyer acknowledges this disclosure. Pre-offer communication between sellers and buyers occurs through masked in-platform messaging that does not expose direct contact information.
All seller searches, invitations, and buyer interactions are logged in an immutable audit trail.
Between Lucid entities: Lucid Realty and Lucid Private Market may share your information with each other to provide integrated brokerage and platform services. For example, buyer verification data collected by the platform may be used by the brokerage to facilitate a transaction.
Service providers: We share information with third-party service providers who perform services on our behalf, including payment processing (Stripe), email delivery (SendGrid), SMS verification (Twilio), identity verification providers, cloud hosting and storage (AWS), and search infrastructure (Meilisearch). These providers are contractually required to use your information only to provide their services to us.
Transaction counterparties: When a buyer submits an offer, the buyer's identity and offer terms are shared with the seller and, if applicable, the seller's or buyer's agents. This disclosure is a necessary part of the real estate transaction process and is acknowledged by the buyer before submission.
Referral brokerages: If a seller elects to escalate from private marketing to MLS listing through a referral brokerage, information necessary to facilitate the referral and subsequent listing may be shared with the receiving brokerage.
Legal requirements: We may disclose your information if required by law, regulation, legal process, or governmental request, or if we believe disclosure is necessary to protect the rights, property, or safety of Lucid, our users, or the public.
Business transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred as part of the transaction. We will notify you of any such change.
We retain your personal information for as long as your account is active or as needed to provide services. Audit logs are retained indefinitely as required for compliance and dispute resolution. Buyer verification data is retained for the duration of active verification and for a reasonable period thereafter. Financial documents (proof of funds, pre-approval letters) are retained only as long as necessary for verification purposes and are deleted when no longer needed.
Transaction records are retained for a minimum of five years in compliance with Florida real estate record-keeping requirements under Florida Statute Chapter 475.
You may request deletion of your account and associated data by contacting us at info@lucidoffer.com. Certain information may be retained as required by law or for legitimate business purposes (audit logs, transaction records, legal compliance).
We use cookies and similar technologies to operate our websites and platform. These include:
Essential cookies: Required for platform functionality, authentication, and security. These cannot be disabled while using our services.
Analytics cookies: Used to understand how visitors interact with our websites and to improve our services. You may opt out of analytics cookies through your browser settings.
We do not use advertising or third-party tracking cookies. We do not participate in cross-site tracking or behavioral advertising networks.
We implement technical and organizational measures to protect your personal information, including encryption of data in transit (TLS/SSL), encrypted storage of sensitive documents, access controls and authentication requirements, audit logging of data access, and regular security reviews.
No method of electronic storage or transmission is completely secure. While we take reasonable measures to protect your information, we cannot guarantee absolute security.
In the event of a data breach involving personal information, we will notify affected individuals and the Florida Department of Legal Affairs as required by the Florida Information Protection Act (Florida Statute 501.171).
You have the right to:
Access the personal information we hold about you. Correct inaccurate or incomplete personal information. Delete your account and associated personal information, subject to legal retention requirements. Withdraw consent for optional data processing activities. Opt out of non-essential communications.

Our services are not directed to individuals under the age of 18. We do not knowingly collect personal information from children. If we become aware that we have collected personal information from a child under 18, we will take steps to delete that information.
Florida residents: Lucid Realty operates exclusively in Florida and complies with the Florida Information Protection Act (F.S. 501.171) regarding data breach notification and the Florida Deceptive and Unfair Trade Practices Act (F.S. 501.204) regarding consumer protection. Real estate transaction records are maintained in compliance with Florida Statute Chapter 475.
California residents: If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA). Lucid does not currently operate in California, but if applicable, you may contact us to exercise your CCPA rights.
Our websites may contain links to third-party websites or services. We are not responsible for the privacy practices of these third parties. We encourage you to review the privacy policies of any third-party services you access through our sites.
We may update this Privacy Policy from time to time. Changes will be posted on this page with an updated "Last updated" date. If we make material changes, we will notify you by email or through a notice on our website. Your continued use of our services after changes are posted constitutes your acceptance of the updated policy.
